Terms of Service

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

You are responsible for the accuracy of your registration information, for safeguarding your credentials, and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security or legal risk.

Paid plans are billed in advance on a recurring basis through our payment processor. By subscribing you authorize recurring charges until you cancel. Fees are non-refundable except where required by law or expressly stated. We may change pricing on prospective notice; continued use after a change constitutes acceptance. You are responsible for applicable taxes.

You agree not to use the Service to, and not to permit any third party to:

• violate any law, regulation, or third-party right, or promote illegal activity;
• upload, generate, or distribute content that is unlawful, defamatory, harassing, hateful, or infringing;
• impersonate any person or entity, or misrepresent your affiliation, including recording or cloning a person’s voice or likeness without their consent;
• generate fraudulent, deceptive, or manipulative content, including for scams, phishing, or disinformation;
• attempt to gain unauthorized access to the Service, other accounts, or connected systems; probe, scan, or test the vulnerability of the Service; or circumvent authentication, rate limits, or usage controls;
• introduce malware, or interfere with, disrupt, or place undue load on the Service or its infrastructure;
• scrape, harvest, or collect data from the Service except as expressly permitted;
• reverse engineer, decompile, or attempt to extract source code or underlying models, except to the extent such restriction is prohibited by law;
• resell, sublicense, or provide the Service to third parties without our written authorization.

We may investigate suspected violations, remove or disable content, and cooperate with law enforcement. We reserve the right to suspend or terminate access for conduct we determine, in our sole discretion, to be unlawful or harmful.

The Service lets you record, upload, and process audio, transcripts, and other content (“User Content”). You retain ownership of your User Content. You grant Atmakosh LLC a limited, non-exclusive, worldwide license to host, process, and transmit your User Content solely to operate and improve the Service for you.

You represent that you have all necessary rights and consents for any User Content you submit, including the consent of any identifiable individuals whose voice or likeness is captured. You are solely responsible for complying with recording-consent and privacy laws applicable to you.

OratoPlus uses automated and AI systems to score speech, generate coaching, and produce other output. AI output may be inaccurate, incomplete, or unsuitable for your purpose, and is provided for practice and informational purposes only. It is not professional, legal, medical, financial, or other regulated advice. You are responsible for reviewing and validating any output before relying on it.

The Service, including its software, models, design, and trademarks (including “OratoPlus” and “Atmakosh LLC”), is owned by Atmakosh LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service in accordance with these Terms. No other rights are granted.

The Service may integrate third-party services (for example, payment processing and AI providers). Your use of those services may be subject to their own terms, and we are not responsible for third-party services.

Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Atmakosh LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.

You agree to indemnify and hold harmless Atmakosh LLC and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.

You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, create risk or legal exposure, or for prolonged inactivity. Upon termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

We may modify or discontinue the Service, in whole or in part, at any time. We may update these Terms; if we make material changes we will provide reasonable notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there for any dispute not subject to binding arbitration, where applicable. Nothing here limits any non-waivable statutory rights you may have.
